What is notice pay?

A party who wishes to terminate an indefinite-term employment contract must notify the other party in advance. A party who terminates the contract without observing the notice period pays notice pay (severance in lieu of notice) equal to the wages for that period (Labor Law No. 4857, Art. 17). Notice pay is most often paid by the employer; however, an employee who resigns without observing the notice period may also be required to pay notice pay to the employer.

Notice periods

Notice periods are determined by the employee's length of service at the workplace:

Length of serviceNotice period
Less than 6 months2 weeks (14 days)
6 months – 1.5 years4 weeks (28 days)
1.5 years – 3 years6 weeks (42 days)
More than 3 years8 weeks (56 days)

These periods are minimums; they may be extended by the employment contract but cannot be shortened. The employer may also terminate the contract immediately by paying the wages for the notice period in advance.

Who is entitled to notice pay?

  • An employee whose indefinite-term employment contract is terminated by the employer without notice or without payment of wages for the notice period,
  • The employer, where an employee resigns without observing the notice period (in this case, the employee pays the employer).

Notice pay does not arise in cases of immediate termination for just cause (Labor Law Art. 24 and Art. 25). Notice pay is also not applicable to terminations during the probationary period or when a fixed-term contract expires. Unlike severance pay, there is no one-year service requirement for notice pay.

How is notice pay calculated?

Notice pay is calculated on the basis of the gross "dressed" salary (gross salary including benefits): the daily wage is found by dividing the gross monthly dressed salary by 30, then multiplying it by the number of days in the notice period. Unlike severance pay, notice pay has no ceiling.

Sample calculation

For an employee who started work on 01.01.2015, was dismissed on 01.01.2026 without notice, and had a gross monthly salary of 30,000 TL:

  • Because the length of service exceeds 3 years, the notice period is 8 weeks (56 days)
  • Daily gross wage: 30,000 ÷ 30 = 1,000 TL; gross notice pay: 1,000 × 56 = 56,000.00 TL
  • Income tax (15%): 8,400.00 TL; stamp tax (0.759%): 425.04 TL
  • Net notice pay: 47,174.96 TL

What deductions apply to notice pay?

Notice pay is subject to income tax and stamp tax; no social security (SGK) premium is deducted. The income tax rate starts at 15% and increases according to the employee's cumulative tax base for that year. You can see the net amount by selecting your tax bracket in our tool.

Job-search leave during the notice period

During the notice period, the employer is required to grant the employee job-search leave of at least two hours per day, without any deduction from wages, so that the employee can find a new job (Labor Law Art. 27). If this leave is not granted, the wages for those periods may be claimed separately.

Statute of limitations and mediation

Notice pay claims are subject to a 5-year statute of limitations, and applying to a mediator is mandatory before filing a lawsuit. You can also use our severance pay calculator to calculate your severance pay, and read our guide to severance and notice pay to learn more about your rights.
